Eugene Triston was re-sentenced in front of Judge William J. McGovern III Thursday after pleading guilty to second-degree endangering the welfare of a child -- several months after Deputy Attorney General Brandy Malfitano of the Division of Criminal Justice, who handled the sentencing for the state, announced her intent to appeal the sentence. Triston was represented by attorney Steven Insley. When the state appeals a sentence, a court of appeals looks at the legality of the sentence, making sure it falls under the terms of state statute, and determines if the judge followed sentencing guidelines. If it determines the sentence did not follow state statute or was too lenient, the case will be sent back to the judge to re-sentence the defendant, according to statutory provisions under New Jersey Superior Court sentencing law.
